0:00:00 Speaker: This regular session, Hot [name] City [name] Council will come to order February 18th

0:00:04 Speaker: at exactly 6 30 p .m.

0:00:10 Speaker: Thank you for the roll call. Thank you, minority.

0:00:13 Speaker: [name] here. [name] here.

0:00:17 City Attorney: [name] here. It's your luggage.

0:00:21 Speaker: All present. We have a floral

0:00:23 Speaker: invocation.

0:00:26 Speaker: Do you want

0:00:44 Speaker: to be counting in prayer? we pray that you be with us during this time of such cold weather and be with those that may be without heat and are having difficulty in staying warm Lord. We pray for those that are sick and pray for their healing Lord Jesus. We thank you for this time that we're able to be together and pray for your wisdom and guidance as we make our way through and Jesus made my pray Amen. Amen. I'll ask for of the

0:01:15 Speaker: Pledge of Allegiance, please.

0:01:20 Speaker: I pledge allegiance

0:01:21 Speaker: to the flag of the United States

0:01:24 City Attorney: of America, and to the Republic for which it stands, one nation, under God,

0:01:31 Speaker: indivisible, with

0:01:32 Speaker: liberty and

0:01:33 Speaker: justice for all. Thank you.

0:01:38 Speaker: Do we have any public comments tonight?

0:02:07 Speaker: This

0:02:12 Speaker: is pertaining to the USDA. We would like to know what the timeframe is for a comprehensive road plan. We would also like to know when we will get that for sustainable roads. I and several citizens have had to pay 1000s of dollars in repairs over the last two years to our vehicles and we would like something that is more sustainable than just gravel and sand. This is an issue that has been going on for more than the last 10 years before the current city administration. And with the USDA negotiations, we would like to know how this is proceeding.

0:04:29 Speaker: Does

0:04:40 Speaker: any of Council have

0:04:42 Speaker: any questions on

0:04:57 Speaker: These check marks are there that they've completed, I know, [name].

0:05:01 Speaker: Yes, ma 'am.

0:05:04 Speaker: Yes, ma 'am.

0:05:07 Speaker: Is this station three repaired?

0:05:11 Speaker: That's the number. Check mark.

0:05:13 Speaker: That's the number of calls.

0:05:15 Speaker: Oh, three call outs,

0:05:17 Speaker: yeah. Oh,

0:05:20 Speaker: three or two.

0:05:22 Speaker: Call outs, ma 'am. Okay.

0:05:26 Speaker: It does have road work repairs checked on here. Do we have do we

0:05:30 Speaker: know where

0:05:31 Speaker: the

0:05:32 Speaker: repairs were done? Yeah, they've done repairs all over. They've done repairs on [name]. They've done repairs on the critical more is

0:05:41 Speaker: all throughout the city.

0:05:43 City Attorney: Okay, yeah, case three. So they've been working all throughout the city. Okay.

0:05:51 Speaker: [name] was more than likely

0:05:53 Speaker: that [name] lift

0:05:54 Speaker: station. You

0:05:55 Speaker: know, one we

0:05:55 Speaker: have

0:05:56 Speaker: a

0:05:56 Speaker: problem.

0:06:10 Speaker: Any other questions?

0:06:12 Speaker: Yes, is that all the

0:06:13 Speaker: repairs on the

0:06:17 Speaker: stations?

0:06:20 Speaker: Well, that's just the repairs when

0:06:22 Speaker: they had a call out. Right. But that's it. Yeah, yeah, we didn't have any $45 ,000.

0:06:32 Speaker: expenditures. Okay.

0:06:35 Speaker: I'm happy to say

0:06:36 Speaker: I don't have anything

0:06:37 Speaker: like that

0:06:37 Speaker: to

0:06:38 Speaker: call

0:06:39 Speaker: out for probably just for a light being on. Yes.

0:06:43 Speaker: That means sometimes

0:06:45 Speaker: somebody will call them in independently.

0:06:48 Speaker: One of the officers will see it or

0:06:50 Speaker: they'll discover it in their daily

0:06:51 Speaker: checks

0:06:52 Speaker: that that's

0:06:53 Speaker: usually related to a call out for somebody calling to pay the lights on

0:06:57 Speaker: or Okay, we're

0:07:13 Speaker: going to move on to item B because there's no

0:07:15 Speaker: decisions on those.

0:07:19 Speaker: USDA update.

0:07:23 Speaker: Meeting the USDA for January and

0:07:25 Speaker: February, I did miss a couple of these meetings. One was because it was cold and one was because I couldn't make it to the meeting because I broke my ankle.

0:07:33 Speaker: And they have included discussions on P &L completion for October, November and December, which council should receive a copy of

0:07:44 City Attorney: do

0:07:45 Speaker: we have a copy of those panels for the council copies of that for that council and for

0:07:57 Speaker: the public yeah

0:07:59 Speaker: mayor if you'll make a note of that

0:08:01 Speaker: well we can

0:08:02 Speaker: put it on the next agenda to have those

0:08:04 Speaker: and hopefully more than that

0:08:09 Speaker: discussion

0:08:22 Speaker: about was about the

0:08:24 Speaker: up -and -coming rate study by

0:08:27 Speaker: Mr. [name] at communities unlimited included that all items have been provided that he needs to do the rate study there should be a

0:08:37 Speaker: workshop

0:08:38 Speaker: in March

0:08:39 Speaker: hopefully by the end of March

0:08:40 Speaker: to

0:08:41 Speaker: discuss

0:08:42 Speaker: the

0:08:44 Speaker: study and to answer the

0:08:45 Speaker: council's question

0:08:46 Speaker: questions you have workshop is informational

0:08:50 Speaker: only there be no decision at that

0:08:53 Speaker: workshop but

0:08:54 Speaker: all

0:08:55 Speaker: council

0:08:55 Speaker: will be updated and

0:08:57 Speaker: I believe communities unlimited will actually be

0:08:59 Speaker: here right

0:09:00 Speaker: it's gonna be a like

0:09:01 Speaker: a training

0:09:02 Speaker: yes

0:09:03 Speaker: the training

0:09:03 Speaker: for the council that communities unlimited is

0:09:06 Speaker: gonna conduct

0:09:08 Speaker: it

0:09:12 Speaker: was confirmed that the USDA received a payment from the city for fifty five thousand two hundred and three dollars and twelve cents

0:09:20 Speaker: along with the monthly payments of $1 ,800.

0:09:23 Speaker: And it was all received by the USDA.

0:09:29 Speaker: The most important point

0:09:30 Speaker: for today's meeting

0:09:31 Speaker: this morning's meeting

0:09:32 Speaker: was the rate study is on track to be finished by the end of March and with seed workshop to update council. If rate study and budget passes by council

0:09:43 Speaker: reconciliation,

0:09:44 Speaker: our reap armaturization,

0:09:46 Speaker: sorry, will start in a very short period of time after that.

0:09:54 Speaker: Do you have anything to add?

0:09:55 Speaker: I

0:09:56 Speaker: gave a short version.

0:09:59 Speaker: Yeah, go ahead. Okay, the process will be that communities unlimited will finish its work. There will be a workshop with the council in which you will learn what communities unlimited has done and what the potential proposals are by communities unlimited for the city. Thereafter there will be an opportunity for the council to determine whether or not to accept a proposal from the USDA special assets unit to determine what the what the reamortization would be. I suspect that that will be pretty much cut in stone. It will either be accepted or rejected. Please be aware that if the council accepts it, all of the current interest will be rolled into the new loan.

0:11:12 City Attorney: The prospects for a lower interest rate do not appear to be in the offing. In other words, it's likely to be the same or possibly higher. There does not appear to be a great deal of confidence from the SAU that an interest rate would be lower. The new, the reamortization loan will, in addition to having the present accumulation of interest rolled in principle on which the city would then be paying interest on that figure which is principle plus interest from the previous loan the reamortization would include interest for what would be in that figure the principle plus interest at the time of reamortization will become the entire principle at that time and the city would be making its payments on that basis plus interest. The

0:12:22 Speaker: way the gentleman spoke,

0:12:23 Speaker: it would go pretty fast after, if the right study

0:12:27 Speaker: were in agreement with it and we're in agreement with the,

0:12:30 Speaker: after

0:12:32 Speaker: the workshop we have. From a legal, go ahead. On the budget.

0:12:38 City Attorney: From a legal standpoint, well for openers, Communities Unlimited is working of what what can be considered a pro forma budget based on the city's offerings of financial information to date. And that's what the rate study is going to include is that pro forma budget. Hopefully that pro forma budget will also assist the city in determining a budget for the next fiscal fiscal year, that figure would by—that figure that shows up in the pro forma budget is largely what the SAU is going to determine the potential reamortization at. that reamortization may very likely result in higher payments to the city from the city to USDA. When the city makes its determination, when the council makes its determination of accept or reject, I would let the city know now that the statutory framework under which the city must operate indicates that the city must adopt a budget and taxes sufficient to cover the obligation. So that's something that will probably be addressed more fully in the workshop. I'm kind of giving you, so that you don't get sticker shock when it hits, I'm giving you this information in advance so that you have perhaps an opportunity to understand that process and what the statutory requirements on the city are. It is not an option to try to negotiate on your on the tax agreements, it very likely will include a higher tax obligation for the city residents, the property owners. So just to let you know that up front so that nobody is terribly surprised. Again, I expect this will be very fully addressed in the workshop to come, which will be after communities unlimited gets their information completed I

0:15:23 Speaker: want this council to know it's completely up to

0:15:26 Speaker: the city and the council

0:15:28 Speaker: whether this is

0:15:29 Speaker: accepted or rejected and the way at the meeting we'll find out what

0:15:34 Speaker: more

0:15:35 Speaker: a lot

0:15:35 Speaker: more information than we know right now

0:15:38 Speaker: this is not just all you have to do this

0:15:41 Speaker: right

0:15:42 Speaker: this is

0:15:43 Speaker: this is

0:15:43 Speaker: we'll be discussing and discussing numbers

0:15:46 Speaker: and discussing

0:15:47 Speaker: everything at this

0:15:48 Speaker: workshop.

0:15:50 Speaker: Yes, [name]? Um, Ms. [name] is

0:15:52 Speaker: happy to talk to her. My

0:15:55 Speaker: concern is, um, my last recollect of the amount of interest that was due was over a half a million dollars. It was like $625 ,000. And if you're telling me that we're going to roll that in, I don't know how much has been

0:16:12 Speaker: written

0:16:13 Speaker: out.

0:16:14 Speaker: How much did you say? 225 ,000 was my last recollect of how much interest was to you at that time so

0:16:23 Speaker: I think

0:16:23 Speaker: it's more like three hundred and thirty

0:16:25 Speaker: thousand

0:16:25 Speaker: from the what yeah What is his name? [name]? Mr. [name]? Or [name]? Mr. [name] sent from January shows the interest of like three hundred and a number

0:16:41 Speaker: of things that

0:16:41 Speaker: we did ask for today in the Special

0:16:45 Speaker: Asset Unit meeting was

0:16:46 Speaker: for the USDA to go

0:16:48 Speaker: back through their

0:16:49 Speaker: records

0:16:49 Speaker: and try to give

0:16:51 Speaker: us an

0:16:52 Speaker: amount of

0:16:53 Speaker: what

0:16:54 Speaker: we paid for you know what have we paid what

0:16:57 Speaker: has the city

0:16:57 Speaker: paid

0:16:57 Speaker: from

0:16:58 Speaker: the present to now so

0:17:01 Speaker: from

0:17:02 Speaker: the inception of the contract now right which would have been of

0:17:06 Speaker: seven I think is when they initially started payment

0:17:09 Speaker: and

0:17:10 Speaker: they were

0:17:11 Speaker: also paying

0:17:11 Speaker: interest

0:17:12 Speaker: in O7.

0:17:16 Speaker: When we get the

0:17:17 Speaker: Mayor,

0:17:18 Speaker: when we get the financials for next time, we need to include all of that information. All

0:17:23 Speaker: of this is going to come to light for the council.

0:17:27 Speaker: When you have the

0:17:28 Speaker: workshop,

0:17:29 Speaker: that's why

0:17:29 Speaker: we're trying to get

0:17:30 Speaker: all of our questions answered because what's fixing

0:17:32 Speaker: to happen when this comes down the pipe. This is a

0:17:35 Speaker: really big

0:17:36 Speaker: decision for this council, because you're

0:17:38 Speaker: talking about another 40 -year debt plan,

0:17:41 Speaker: you

0:17:41 Speaker: know,

0:17:42 Speaker: and one of the things

0:17:43 Speaker: that I was asked today was, you

0:17:46 Speaker: know, what other options do we have?

0:17:49 Speaker: And my response was, well, you guys kick us off the cliff

0:17:52 Speaker: or we accept whatever

0:17:54 Speaker: you

0:17:56 Speaker: put out there.

0:17:56 Speaker: I don't anticipate that any of the suggestions, recommendations or offerings from the USDA, I don't think any of those are going to be negotiable. I think it's going to be vote yes for this or don't.

0:18:14 Speaker: Right. There will be no

0:18:15 Speaker: vote at the workshop. You will have complete information before you're and thank you get time to think about it before you

0:18:22 Speaker: make any kind of decisions.

0:18:24 Speaker: Right. The workshop is not a voting

0:18:26 Speaker: agenda. And

0:18:27 Speaker: that's what it's for to

0:18:28 Speaker: bring the information to you.

0:18:30 Speaker: And the best as

0:18:31 Speaker: totally as as we can, but we get from them.

0:18:36 Speaker: Okay,

0:18:37 Speaker: so I guess my concern is these payments are being made is $1 ,800 payments and the 55 ,000 just paid or these are actually going towards a principal or interest.

0:18:47 Speaker: Okay, yes, interest, interest,

0:18:49 City Attorney: personal interest,

0:18:50 Speaker: personal interest. So yes, I can see where you're taking all that is going to pure interest. And if it was 600 ,000, and I can see how that's going to accumulate and reduce the 600 ,000 down to three something. But that's a sad part of that is this is your interest. And that has been touched on the principal. So that's a major concern.

0:19:13 Speaker: Well,

0:19:15 Speaker: that's probably

0:19:16 Speaker: the

0:19:19 Speaker: numbers for you understand right now.

0:19:21 Speaker: And

0:19:21 Speaker: as soon

0:19:22 Speaker: as they give us more information, then we'll because

0:19:25 Speaker: what

0:19:27 Speaker: what

0:19:27 Speaker: Mr. [name]

0:19:28 Speaker: said today is

0:19:29 Speaker: that they

0:19:29 Speaker: they don't

0:19:30 Speaker: have it as they use special I said they don't have it but the finance department likely would have that right likely to have that information

0:19:38 Speaker: they may not

0:19:39 Speaker: be able to break it down in from

0:19:41 Speaker: the

0:19:42 Speaker: beginning to now

0:19:43 Speaker: how much did we pay an interest versus principal but I think everybody knowing the number the total

0:19:51 Speaker: what did we pay

0:19:52 Speaker: because

0:19:53 Speaker: well

0:19:54 Speaker: I mean we were provided a paper recently when I asked for the 55 ,000 what we'd originally been paying is the 1800 a month comes out every month and

0:20:03 Speaker: then two times a year once in

0:20:04 Speaker: February and once in August payments I believe it's 24

0:20:07 Speaker: ,000

0:20:10 Speaker: okay

0:20:10 Speaker: and that's what had

0:20:11 Speaker: been being made

0:20:11 Speaker: but this particular time instead of the $24 ,000 they asked for 55

0:20:16 Speaker: ,000

0:20:18 Speaker: you know

0:20:18 Speaker: and so of course the first question is, is that going to be the norm at the moment? We don't know what the norm

0:20:24 Speaker: is going to be until

0:20:25 Speaker: all these numbers come back and then everybody's going to follow this council's decisions.

0:20:29 Speaker: And he also

0:20:30 Speaker: did discuss that it's going to be re -alleged or us that the March

0:20:35 Speaker: payment we

0:20:36 Speaker: might hold that

0:20:36 Speaker: until it's actually done so that the March payment can go in with

0:20:40 Speaker: the future payments.

0:20:43 Speaker: As long as they don't end up inadvertently

0:20:45 Speaker: holding that against us.

0:20:47 Speaker: That was their idea,

0:20:49 Speaker: not ours.

0:20:50 Speaker: Right. Well,

0:20:50 Speaker: if I remember correctly, I believe was 55 ,000 in February was supposed to be the original amount that was going to the principal. And then we had another 24 ,000 in August to stay for interest. So our payment action was like $77 ,000. But if you're telling me that all those moneys were those original amount was $77 ,000 a year, $77 ,000, $78 ,000. So if we're saying that these the money that we've been paying for the last couple years I've been paying is all going towards interest. Now it's split. It's already actually getting some we actually get going

0:21:25 Speaker: towards the

0:21:26 Speaker: principal. Yes,

0:21:27 Speaker: we are getting some it's going towards the principal. Hopefully by the time we have the workshop will actually have some good solid numbers so you can actually see that.

0:21:34 Speaker: You

0:21:35 Speaker: know, versus us just saying it.

0:21:38 Speaker: But yeah, there is a portion.

0:21:40 Speaker: thank you just

0:21:42 Speaker: to inform the city as

0:21:52 City Attorney: of January 8th

0:21:58 City Attorney: we received from Miss [name] from the USDA statement that the the interest that is presently outstanding is 350 ,000, at that time, $350 ,235 .28. The outstanding principal was $1 ,436, $436 ,800. That was as of January 8th. that probably has changed because the city has made a twenty three thousand two hundred three dollar and twelve cent payment interest payment and a principal payment of thirty two thousand dollars and that occurred in February I think

0:23:02 Speaker: the 1 .4 number that

0:23:03 Speaker: you mentioned,

0:23:04 Speaker: right, was

0:23:05 Speaker: actually

0:23:05 Speaker: the total,

0:23:07 Speaker: right, of everything at that time. Right,

0:23:11 Speaker: but again the number of like 330

0:23:13 Speaker: ,000

0:23:14 Speaker: that was principal,

0:23:15 Speaker: 300 and something

0:23:16 Speaker: thousand

0:23:17 Speaker: that

0:23:18 Speaker: was

0:23:18 Speaker: interest.

0:23:21 Speaker: There were two different numbers, the total, right, that's pretty scary. The

0:23:25 Speaker: start of that was

0:23:26 Speaker: a $1 .5 million debt.

0:23:29 Speaker: January 8 is 1 .4 million.

0:23:33 Speaker: And all that's gone towards interest. No, we made a please made a lot of money.

0:23:41 Speaker: I would remind the council that the payments that have been made that have brought—well, let me back up. Somewhere prior to 2018, the city was not making payments. I can say that beginning in approximately March or April of 2022, the city realized that there had been payments that had not been made prior to the current city personnel, the current city staff, and began trying to work on getting those payments brought up to date. It is over the last year the city has made substantial inroads on the obligation as a result of, I mean they the city had already begun working on that problem before January of 2023 when special assets unit became involved right and when special assets unit became involved the city already was making substantial efforts to bring that obligation current special assets I don't know what prompted special assets that's to be involved, except that it had to be the fact that there was a substantial delinquency that the city was trying to recover from. In the last year, the city has met, well, since 2023 and possibly before that, the city has met every payment obligation that appeared on the 2013 workout

0:25:35 Speaker: agreement. right,

0:25:36 Speaker: the city was in default, apparently in 2013, we did not even know that there was a 2013 workout agreement between

0:25:45 Speaker: the city of Hawk Cove and the

0:25:46 Speaker: USDA

0:25:46 Speaker: until

0:25:48 Speaker: the special assets unit became involved. And everybody was kind of blindsided because nobody

0:25:53 Speaker: knew

0:25:54 Speaker: anything.

0:25:56 Speaker: Well, yeah, and I

0:25:57 Speaker: mean, if you look at

0:25:58 Speaker: that, that workout agreement, it didn't look like it was a difficult task

0:26:01 Speaker: to take on

0:26:03 Speaker: but nobody

0:26:04 Speaker: knew that the existence until they

0:26:06 Speaker: brought it to our attention and said

0:26:07 Speaker: okay if

0:26:08 Speaker: you guys will

0:26:09 Speaker: start from

0:26:10 Speaker: right now and

0:26:11 Speaker: start going off of that 2013 workout agreement.

0:26:17 City Attorney: Now as of January 8th that was a substantially larger payment that $55 ,000 payment was a Substantially larger payment than what the city has been paying on the workout agreement So we were a little bit perplexed. Okay. Now this is substantially more Than we've been doing with the workout agreement. What has happened with the workout agreement? And what has happened with the workout agreement is a special assets unit and determined that it was necessary for the city to make that payment the $55 ,000 payment with the combination of interest and principal to prove to help to prove we're not there yet but to help to prove the city's viability for the potential of the reamortization.

0:27:28 Speaker: Does

0:27:31 Speaker: I

0:27:32 City Attorney: would like to respectfully suggest that every council member individually maintain a notebook or something where you compile your questions, because there will be even more, I'm sure, as of the workshop, however, it's probably a good idea for each of you to have your own questions prepared ready to be if they're answered during the workshop great as the presentation by communities unlimited progresses but if they are not answered then those questions still remain so please each of you individually maintain a notebook or something that that brings your questions to the workshop.

0:28:29 Speaker: The workshop is twofold.

0:28:31 Speaker: One is to bring as much information

0:28:34 Speaker: to

0:28:35 Speaker: you at

0:28:36 Speaker: the table as possible

0:28:37 Speaker: and the other is for you to

0:28:38 Speaker: get basically training from

0:28:41 Speaker: communities unlimited. That training is

0:28:43 Speaker: going to explain to you

0:28:44 Speaker: the necessity for

0:28:46 Speaker: the

0:28:48 Speaker: financial reporting that that's require, hopefully,

0:28:52 Speaker: some some deep dive information on

0:28:55 Speaker: prioritization, what that means, you know, what that process is, what the options are, if there are any.

0:29:01 Speaker: So I agree to have your

0:29:03 Speaker: questions ready. And like I said, as it goes on, you'll probably have more and that's

0:29:07 Speaker: okay. So we're trying very

0:29:09 Speaker: hard to get as much information available so that when it comes to that time, because like I said, this is a pretty big decision that's coming down the pike. So you need to be armed with that information so that

0:29:20 Speaker: you can make

0:29:21 Speaker: a

0:29:22 Speaker: decision

0:29:23 Speaker: based on what you know.

0:29:25 Speaker: Okay. I have another comment. As this has unfolded over the last year there has been an outstanding question about a seven hundred fifty thousand dollar portion or obligation that the city is responsible for. We were informed today that that $750 ,000 obligation is a portion of and not in addition to the original contract.

0:30:11 City Attorney: It appears to

0:30:12 Speaker: be.

0:30:29 Speaker: Right. So it's not

0:30:30 Speaker: in addition

0:30:31 Speaker: to, so there's not another.

0:30:33 Speaker: Well, I mean everybody

0:30:34 Speaker: had a

0:30:35 Speaker: big question from the beginning

0:30:36 Speaker: of the meetings with the special assets unit. What is that money? What was that $750 ,000? What was it used for?

0:30:44 Speaker: And basically the way

0:30:45 Speaker: he described it to us today

0:30:47 Speaker: is in the

0:30:48 Speaker: original plans, you

0:30:50 Speaker: know, that that was in there and there was

0:30:51 Speaker: going to be water and sewer. and somehow during that process

0:30:56 Speaker: it changed the engineering channels changed and

0:31:00 Speaker: they decided to not go with the

0:31:01 Speaker: water so

0:31:04 Speaker: so are we trying to find a way to get away from that since we didn't do water and we only have

0:31:12 Speaker: soy? well we

0:31:13 Speaker: can't get away from it this

0:31:14 Speaker: is where we all go

0:31:15 Speaker: to the ground so we're still stuck with it

0:31:18 Speaker: it's part of the $1 ,500 ,000 Right. And the water is not included. The $1 ,500 ,000 was exclusively for a sewer. Right, but

0:31:32 Speaker: there was some paperwork in there that suggested

0:31:34 Speaker: that that was

0:31:37 Speaker: used to

0:31:38 Speaker: install water or water lines. I think what we were looking at was the original,

0:31:44 Speaker: you know,

0:31:45 Speaker: engineering plans, and that as it went down the pipe it changed. but that offered some

0:31:49 Speaker: confusion.

0:31:50 Speaker: So we wanted to

0:31:50 Speaker: know where,

0:31:52 Speaker: you know, where did that

0:31:53 Speaker: $750 ,000 go?

0:31:55 Speaker: That was

0:31:55 Speaker: completely straightened out today. It definitely was for the original. It's not nothing that's going to be tacked on.

0:32:00 Speaker: We don't owe any

0:32:00 Speaker: more than what we owe. Yeah,

0:32:02 Speaker: and it only took us how long to

0:32:04 Speaker: get this answer? I mean,

0:32:05 Speaker: it took us, you know,

0:32:06 Speaker: yeah,

0:32:07 Speaker: it took us a

0:32:07 Speaker: while to get the

0:32:08 Speaker: answer. [name] I got

0:32:09 Speaker: snuck in there

0:32:09 Speaker: and nobody knew.

0:32:10 Speaker: It's just the way it was written. Yeah, it's our trick. It's just the

0:32:13 Speaker: way it's written when you

0:32:14 Speaker: look at it.

0:32:15 Speaker: And when you look at

0:32:15 Speaker: it and then I actually start looking down into it,

0:32:28 Speaker: We just

0:32:29 Speaker: thought it was different because it said it was for water, and we're like, well, we don't have water lines installed, so

0:32:35 Speaker: can

0:32:36 Speaker: we have our money done?

0:32:37 Speaker: We still are looking to hopefully receive from the USDA Finance Department. we're still looking to hopefully receive a full breakdown that gives basically a stream of cash payments for the sewer that accumulated and a running balance with deductions for interest payments and or principal payments as they have occurred over time. The difficulty is that we're not certain that even the finance department has the accounting programming that will be able to supply that to us. I will be in contact with the USDA to find out who I need to get the information from and it may be that it's going to amount to an information request process but from the finance department and basically get as much of that information from them as we can.

0:34:07 Speaker: number is. Yeah,

0:34:08 Speaker: exactly what the

0:34:09 Speaker: number is. Yeah.

0:34:10 Speaker: How much did they

0:34:11 Speaker: say?

0:34:12 Speaker: At what point are we starting?

0:34:16 Speaker: It was just discussed

0:34:17 Speaker: today. So not only about what point we're trying to retrieve this information from

0:34:21 Speaker: for the entire loan.

0:34:22 Speaker: It's from inception was

0:34:24 Speaker: right

0:34:25 Speaker: from the

0:34:25 Speaker: beginning. Are you meaning

0:34:26 Speaker: from the beginning?

0:34:27 Speaker: Yes.

0:34:28 Speaker: [name] or that's my question. From day one.

0:34:33 Speaker: What's the questions?

0:34:34 Speaker: We're about right on that. Yeah, the first

0:34:36 Speaker: penny

0:34:37 Speaker: spent towards

0:34:39 Speaker: that,

0:34:40 Speaker: towards that loan

0:34:41 Speaker: towards that debt, we want to know what was the first penny spent and what is it again, how much did we spent today? What's the total? Because we don't know.

0:34:50 Speaker: We know that they did

0:34:50 Speaker: begin making

0:34:51 Speaker: payments in 2007.

0:34:53 Speaker: And what we're hoping is the finance department will be able to give us from inception, a running balance that shows interest payments and principal payments so that we have a complete picture of how this loan has progressed from 2007.

0:35:17 Speaker: Right. So

0:35:19 Speaker: we're not 100 % sure that they can provide it for us but they did direct us to go to the finance department.

0:35:24 City Attorney: So we're gonna ask or I'm gonna ask frankly and if I need to I'll FOIA that on behalf of the city.

0:35:35 Speaker: Are we ready to move on to [name] C? I've received a fire

0:35:45 Speaker: report.

0:35:46 Speaker: No action. Since we missed last month,

0:35:50 Speaker: there are

0:35:52 Speaker: two

0:35:52 Speaker: reports in there that's giving

0:35:54 Speaker: you

0:35:54 Speaker: their

0:35:55 Speaker: run calls within our city and the ETJ,

0:35:59 Speaker: or territorial jurisdiction.

0:36:28 Speaker: Well, TALCOME and our

0:36:29 Speaker: ETJ, our extra territorial jurisdiction, So from the city's incorporated limits,

0:36:36 Speaker: the ETJ or the

0:36:37 Speaker: extra territorial

0:36:38 Speaker: jurisdiction is approximately one half mile,

0:36:42 Speaker: and that's what this

0:36:43 Speaker: includes. Sorry, I did one

0:36:45 Speaker: direction.

0:36:49 Speaker: The other one I just thought,

0:36:50 Speaker: I thought it was more clear when I did it last night.

0:37:05 Speaker: Well, you have

0:37:06 Speaker: to look at the ETJ map.

0:37:09 Speaker: [name], it looks like a cloud, sort of. Like

0:37:12 Speaker: yeah,

0:37:13 Speaker: it's not

0:37:13 Speaker: like a straight line like either thing.

0:37:17 Speaker: Yeah, that's what was in my mind.

0:37:19 Speaker: Well, mine too. And so I thought that if you didn't have all the food,

0:37:23 Speaker: and the green ones are actually inside my home.

0:37:31 Speaker: More. Yes.

0:37:36 Speaker: Moving on to item D 2024

0:37:38 Speaker: racial profiling report.

0:37:46 Speaker: This one's pretty

0:37:47 Speaker: thick,

0:37:47 Speaker: because it

0:37:48 Speaker: has your

0:37:49 Speaker: initial

0:37:50 Speaker: report

0:37:50 Speaker: is required about the state and

0:37:53 Speaker: then there's also a comprehensive

0:37:54 Speaker: analysis

0:37:55 Speaker: that

0:37:56 Speaker: is on the back part and they are separated by the staples. Yes, the state of Texas requires

0:38:07 Speaker: that we

0:38:07 Speaker: do

0:38:09 Speaker: racial profiling reports

0:38:10 Speaker: for any

0:38:11 Speaker: agency that makes

0:38:12 Speaker: traffic stops.

0:38:32 Speaker: What is the time frame on this

0:38:34 Speaker: for

0:38:34 Speaker: the year?

0:38:35 Speaker: Yes ma 'am for the year 2024.

0:38:38 Speaker: Okay. That has to be turned into the Attorney General's office before

0:38:41 Speaker: March

0:38:41 Speaker: every year but

0:38:43 Speaker: and we

0:38:44 Speaker: do the preceding

0:38:45 Speaker: year

0:38:46 Speaker: yeah

0:38:55 Speaker: I

0:38:56 Speaker: think

0:38:58 Speaker: it ends in January I think it is the

0:39:01 Speaker: calendar calendar

0:39:03 Speaker: year there's

0:39:25 Speaker: criteria that has to be met

0:39:26 Speaker: anytime

0:39:27 Speaker: that

0:39:28 Speaker: police officer might contact the

0:39:29 Speaker: violator go on the citation that would list things like was that person's race

0:39:35 Speaker: or ethnicity known prior

0:39:37 Speaker: to the stop. The majority of the time it is not but it always has to be listed on each citation

0:39:43 Speaker: so that means over 364

0:39:46 Speaker: stops

0:39:47 Speaker: and

0:39:48 Speaker: so those that

0:39:50 Speaker: information had to be listed 364 times for each violator Okay,

0:39:58 Speaker: if we're only not married with the statements, we need to do it. So

0:40:01 Speaker: so we do it.

0:40:19 Speaker: Can I have any questions?

0:40:27 Speaker: Questions? Move on to item P discuss

0:40:31 Speaker: considering take action

0:40:33 Speaker: on the ordering of the election.

0:40:38 Speaker: Before we start on this question.

0:40:45 Speaker: Sorry.

0:40:47 Speaker: the posting

0:40:47 Speaker: of the notice of the deadline for a place on the ballot because it wasn't posted

0:40:52 Speaker: until

0:40:53 Speaker: around the

0:40:54 Speaker: 14th or

0:40:55 Speaker: so of the

0:40:56 Speaker: January it's supposed to be posted December 16th

0:40:59 Speaker: I did

0:41:00 Speaker: call the secretary

0:41:00 Speaker: of state to make sure there's no going

0:41:02 Speaker: to be any problem with that and they said no there would be no problem with that only if somebody come up and said hey I didn't know that was there

0:41:09 Speaker: and they could take it to court

0:41:11 Speaker: and blah blah blah but otherwise there's no problem with that date being on there and the

0:41:24 Speaker: notice honey by

0:41:26 Speaker: March 4th

0:41:29 Speaker: and

0:41:29 Speaker: the

0:41:31 Speaker: previous election

0:41:34 Speaker: was paid in

0:41:34 Speaker: full

0:41:35 Speaker: first

0:42:04 Speaker: can

0:42:07 Speaker: I get a motion to order the election for hot

0:42:09 Speaker: co for May the

0:42:10 Speaker: 3rd I believe

0:42:18 Speaker: yes

0:42:25 Speaker: I have

0:42:26 Speaker: a motion to have a second, please.

0:42:31 Speaker: I got

0:42:32 Speaker: a

0:42:33 Speaker: second. All those in favor

0:42:35 Speaker: of

0:42:36 Speaker: order of

0:42:36 Speaker: the general election for May 3rd, 20 .5, please say aye.

0:42:41 Speaker: Any opposed?

0:42:45 Speaker: Order passes.

0:42:47 Speaker: And I'm going to start this down there. and we need your signatures

0:42:50 Speaker: on persons. And while they're doing

0:43:04 Speaker: that, I don't have discussed consider and take

0:43:08 Speaker: action on notice of the election

0:43:10 Speaker: for

0:43:13 Speaker: potential passing. Yes, we got to

0:43:15 Speaker: order the election.

0:43:21 Speaker: There's a notice.

0:43:23 Speaker: Okay, yeah, this is the notice for the election.

0:43:26 Speaker: Right. Yeah, you just ordered. Yes.

0:43:29 Speaker: This will have to pass. [name].

0:43:31 Speaker: You know, we've already we've got it on here okay

0:43:34 Speaker: this

0:43:36 Speaker: one I just need to sign this

0:43:51 Speaker: is the ordering collection that'll be posted out

0:43:53 Speaker: front

0:43:55 Speaker: And then the order of election notice of election.

0:44:00 Speaker: Yeah, the notice is the one

0:44:01 Speaker: that was

0:44:01 Speaker: actually

0:44:03 Speaker: not

0:44:03 Speaker: allowed.

0:44:04 Speaker: No, I'm

0:44:05 Speaker: going to scan it in

0:44:06 Speaker: and send it to you. OK, and I'm saying what the order is.

0:44:32 Speaker: We have no executive session and a consideration of

0:44:37 Speaker: consecutive session. Do we have any announcements?

0:44:44 Speaker: All right, hold on. I got a supercommoderator.

0:44:48 Speaker: All right, no, no, no, no, no, no, no, no, no.
